B. USER AGREEMENT GOVERNING THE FREE RANGE BUTCHER ORDERS
1. PLACING ORDERS
1.1 THE FREE RANGE BUTCHER provides its Account-holders with opportunities to purchase goods and/or services at specified rates and on these terms and conditions. Where any additional terms are specified on the Website in the description of a particular offer, those terms will apply to that offer in addition to these Terms & Conditions.
1.2 Once you have placed your order you will receive a confirmation of your order (whether by email or via your Account) and your credit card will be charged for the purchase price of the order.
1.3 An order may take the form of physical products being delivered to you and services provided directly to you (such as delivery services).

2. PRICES AND PAYMENT
2.1 All prices are in listed Australian Dollars. All prices are subject to change. All prices displayed on this Website are only valid online at the time shown.
2.2 THE FREE RANGE BUTCHER accepts payment by Visa Card and Master Card.
2.3 Provision of credit card information as payment for the product/s constitutes an agreement for your purchase of the selected product(s) and/or service(s).
2.4 You must not pay or attempt to pay for product(s) and/or service(s) using fraudulent credit card information.
2.5 THE FREE RANGE BUTCHER attempts to accurately present the availability of stock and/or availability to place an order in a specific delivery window; however stock availability and/or delivery capacity availability constantly varies and is only valid at the time shown.
2.6 In the event that an ordered item isn't available or we are unable to fulfil your order we may attempt to arrange an alternative item, an alternate delivery window or will provide a full refund.
3. CANCELLATIONS
3.1 Generally, once you have made an order to purchase products on the Website, you cannot cancel that order. If, after an order has been submitted, you want to cancel or amend an order, we will use reasonable endeavours to cancel or amend that Order in accordance with your instructions, provided that the order has not yet commenced being processed. However, you may be charged the full purchase price if that Order has commenced being processed.
3.2 THE FREE RANGE BUTCHER also reserves the right to cancel your order if:
(a) you provide an unauthorised credit card;
(b) we are unable to process payment on the credit card or other payment details provided;
(c) you provide invalid personal details;
(d) if, when required, you cannot provide acceptable proof of identity;
(e) if, for any reason, we don’t reasonably believe we can successfully complete delivery.
THE FREE RANGE BUTCHER will attempt to notify you before cancelling your order.
4. DELIVERY OF ORDERS
4.1 THE FREE RANGE BUTCHER accepts no liability or responsibility for our products if they are not properly refrigerated by the end time of the delivery window in which it was delivered. For example, if the delivery window is 12pm – 5pm, it is your responsibility to refrigerate your order by 5pm on that day of delivery.
4.2 For standard deliveries in the specified Delivery Area, THE FREE RANGE BUTCHER delivers in the Delivery Zone in accordance with the specified delivery schedule using refrigerated trucks with products packaged in insulated boxes designed to keep maintain the proper temperatures for up to 5.5 hours from delivery.
4.3 If you are not available when the courier delivers your order to the delivery address specified by you, your order will be dropped off at that address. If there is no safe place for the products to be left upon delivery or the specified address cannot be accessed, then the products will be returned to our warehouse and an alternative delivery time will be arranged. This will incur additional delivery costs payable by you.
4.4 If there is no safe place for the products to be left upon delivery or the specified address cannot be accessed the courier may use your contact details to contact you in relation to your delivery.
4.5 Delivery outside of the Delivery Area may be arranged and, if available, will be subject to additional delivery fees.
4.6 In the event a delivered order is stolen or otherwise unlawfully removed or damaged after delivery, then THE FREE RANGE BUTCHER accepts no liability or responsibility for that event occurring.
5. DELIVERY AREA

6. RISK AND TITLE
6.1 The risk of loss of goods shall be passed to you upon our delivery of the order to the delivery address nominated on the relevant order form. You authorise for each order you purchase from THE FREE RANGE BUTCHER to be left at your specified address and your order will have been taken to be delivered when it is dropped off at that address. THE FREE RANGE BUTCHER will not be held responsible for any loss, damage or liability as a result of this authority.
6.2 Title in the order (including the products comprising the order) passes to the purchaser
(a) at the time when the courier delivers the order to the specified address; or
(b) in the event alternate delivery arrangements are made where the purchaser collects the order, title passes to the purchaser at the time the purchaser takes possession of the order.

Subject to claims available under consumer protection laws, neither THE FREE RANGE BUTCHER nor its related bodies corporate (as that term is defined in the Corporations Act 2001) is not liable to you or anyone else (including for negligence, breach of contract or tort) for any loss or damage (including any form of consequential loss such as any third party loss, loss of profits, loss of revenue, loss of opportunity, loss of anticipated savings, pure economic loss and any increased operating cost) however caused and which is suffered directly or indirectly in connection with the goods and services that are the subject of an Order.
7.2 For any claims relating to the goods and services that are the subject of an Order that cannot be excluded or restricted under consumer protection laws:
(a) you will be entitled to a full refund or replacement Order if there is a major failure by THE FREE RANGE BUTCHER to comply with the consumer guarantees under the Australian consumer laws; and
(b) for minor failures by THE FREE RANGE BUTCHER to comply with the consumer guarantees under these laws, the liability of THE FREE RANGE BUTCHER for any applicable claim will (at THE FREE RANGE BUTCHER’s discretion and to the maximum extent permitted by law) be limited to:

You irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of New South Wales.
